19. General Project Terms & Conditions for Florida Windows, Doors, and Shutters

The following General Project Terms & Conditions are intended to give customers and prospective customers advance notice of typical conditions that may apply to impact windows, impact doors, shutters, hurricane protection, installation, maintenance, and related work in Florida. These terms are general and may be modified by a written estimate, signed proposal, contract, invoice, warranty document, manufacturer document, or project-specific agreement.

20. Estimates, Measurements, and Project Scope

All estimates are based on information available at the time of quoting. Initial estimates may rely on customer-provided information, photos, approximate measurements, plans, prior records, or visual review. Final pricing, product selection, lead time, and installation scope may change after field measurement, inspection, engineering review, permit review, manufacturer confirmation, or discovery of hidden conditions.

The customer is responsible for reviewing the written proposal carefully before approval. The written proposal should identify, when applicable, product type, color, glass type, frame type, shutter type, opening count, approximate size, scope of labor, exclusions, permit responsibility, payment schedule, warranty reference, and special conditions.

Verbal discussions, text messages, social media messages, photos, marketing materials, website descriptions, or preliminary conversations do not modify the written scope unless confirmed in writing by ATC by Fiallo.

21. Product Specifications, Approvals, and Code Compliance

Florida impact windows, exterior doors, shutters, and hurricane protection products may be subject to the Florida Building Code, local building department requirements, product approvals, engineering documentation, wind-load requirements, design pressure requirements, installation instructions, and inspection standards.

Product selection must be appropriate for the property, opening, zone, project scope, and applicable code requirements. The customer understands that products advertised as impact, hurricane, windstorm, or wind-borne debris protection must be supported by applicable approval, specification, or documentation where required.

ATC by Fiallo may recommend or provide products based on available information, but final acceptance may depend on permit review, building official approval, manufacturer data, engineering, site conditions, and inspection.

22. Permits, Inspections, and Government Approvals

Many window, door, shutter, and structural-related projects in Florida require permits, notices, inspections, product approval documentation, or local building department review. Permit requirements vary by jurisdiction, property type, scope of work, and applicable code.

Unless the written agreement states otherwise, any required permit fees, plan review fees, engineering fees, notice of commencement recording fees, reinspection fees, correction fees, HOA/condominium approval fees, municipal fees, or government charges may be billed to the customer or included as a separate line item.

ATC by Fiallo is not responsible for delays caused by building departments, permit review, inspection scheduling, rejected inspections, requested corrections, HOA approvals, condominium associations, municipalities, code changes, product approval review, or government closures.

The customer must not request or permit unpermitted work where a permit is legally required. If a customer refuses a required permit, ATC by Fiallo may decline, suspend, or terminate the project.

23. Customer Responsibilities

The customer is responsible for:

● Providing accurate property information, ownership authority, contact information, and project details.
● Obtaining any required HOA, condominium association, landlord, tenant, architectural committee, or community approval unless the written agreement assigns that responsibility to ATC by Fiallo.
● Providing safe and reasonable access to the property, work areas, electrical outlets, parking, elevators, gates, and common areas.

● Removing furniture, window treatments, blinds, decorations, fragile items, valuables, electronics, vehicles, plants, wall hangings, or personal property from work areas unless otherwise agreed.
● Securing children, pets, tenants, guests, employees, and personal belongings during work.
● Disclosing known leaks, structural issues, electrical lines, plumbing, alarm wires, low-voltage wiring, security sensors, prior repairs, mold, termites, wood rot, water intrusion, unsafe conditions, or other relevant conditions.
● Ensuring someone with authority is available for access, decisions, approvals, and final walkthrough when required.

ATC by Fiallo is not responsible for delays, additional costs, damages, or incomplete work caused by inaccurate information, lack of access, unsafe conditions, third-party restrictions, undisclosed conditions, or customer failure to prepare the work area.

24. Existing Conditions and Hidden Damage

Florida properties may have hidden or pre-existing conditions that are not visible before removal or installation. These may include wood rot, termite damage, water intrusion, stucco damage, concrete damage, frame deterioration, structural movement, out-of-square openings, electrical or alarm wiring, plumbing, prior defective work, mold, corrosion, settlement, code deficiencies, or unsafe construction.

Unless specifically included in writing, estimates do not include correction of hidden damage, structural repairs, mold remediation, electrical work, alarm system work, drywall repair, painting, stucco repair, tile repair, landscaping repair, waterproofing beyond the specified installation, engineering upgrades, or work outside the stated scope.

If hidden conditions are discovered, ATC by Fiallo may pause work and provide a change order, recommendation, referral, or revised estimate. Additional work may require additional cost, additional time, permits, engineering, inspections, or third-party specialists.

25. Scheduling, Lead Times, and Delays

Project dates, lead times, delivery windows, and installation schedules are estimates unless expressly stated in a signed agreement. Delays may occur due to weather, hurricanes, tropical storms, emergency conditions, material availability, manufacturer backorders, shipping delays, labor availability, permit review, inspection scheduling, HOA approvals, customer access, change orders, hidden conditions, supply chain issues, payment delays, or events beyond ATC by Fiallo’s reasonable control.

ATC by Fiallo is not responsible for consequential damages, lost rent, lost business, lost profits, inconvenience, relocation costs, insurance issues, or other indirect losses caused by scheduling changes or delays, except where prohibited by law.

26. Deposits, Payments, and Change Orders

Payment terms will be stated in the written estimate, proposal, invoice, or contract. Deposits may be required before ordering materials, reserving production, preparing permits, scheduling work, or beginning installation.

Custom products, special-order materials, engineered products, color-specific items, manufacturer orders, permit work, and project preparation may be non-refundable once ordered, processed, submitted, fabricated, or scheduled, unless otherwise required by law or agreed in writing.

Any change in scope, quantity, product type, color, size, opening condition, hardware, glass, shutter configuration, installation method, permit requirement, hidden repair, or customer-requested modification may require a written change order and additional payment.

Failure to make timely payments may result in project suspension, delayed installation, delayed warranty processing, collection activity, interest or fees if allowed by the written agreement and law, cancellation of scheduling priority, or other remedies available by law.

27. Financing

If financing is offered or discussed, financing may be provided by third-party lenders or financing platforms and is subject to separate approval, credit criteria, terms, disclosures, interest rates, fees, and lender requirements. ATC by Fiallo does not guarantee financing approval unless expressly stated by the lender.

Customer obligations under a financing agreement may be separate from the service agreement with ATC by Fiallo. The customer should review all lender disclosures before signing.

28. Cancellations and Special Orders

Cancellation rights, refund eligibility, restocking fees, and deposit treatment depend on the written agreement, applicable law, project stage, permit status, manufacturer order status, and whether products are custom-made or special ordered.

Because windows, doors, shutters, and impact protection products are often manufactured or configured for specific openings, cancellation after approval, measurement, permit submission, material order, fabrication, or scheduling may result in non-refundable costs.

29. Installation Standards and Finish Expectations

ATC by Fiallo will perform work in a professional manner consistent with the written scope, applicable product instructions, and project conditions. However, installation may involve noise, dust, vibration, removal of existing materials, drilling, cutting, fastening, sealants, anchors, touch-up needs, and minor disruption.

Unless included in writing, the project may not include painting, drywall finishing, stucco finishing, tile work, alarm sensor relocation, blind removal or reinstallation, window treatment installation, cleaning beyond reasonable construction cleanup, landscaping repair, or repair of pre-existing damage.

Color, glass appearance, tint, reflectivity, frame appearance, caulking appearance, hardware, and product dimensions may vary by manufacturer, lighting, batch, product line, and site conditions.

30. Hurricane Protection Limitations

Impact windows, impact doors, shutters, and hurricane protection systems are designed to improve protection when properly selected, installed, maintained, closed, locked, and used according to applicable specifications and manufacturer instructions. No product can make a property hurricane-proof, storm-proof, waterproof, flood-proof, burglar-proof, impact-proof against every object, or immune from damage.

Severe weather, wind-borne debris, flooding, storm surge, structural failure, roof failure, improper use, open products during a storm, lack of maintenance, pre-existing conditions, or conditions exceeding product ratings may cause damage despite installed protection.

Customers are responsible for following manufacturer instructions, closing and locking products before storms, maintaining shutters and tracks, clearing obstructions, and taking reasonable storm preparedness measures.

31. Warranties

Products may carry manufacturer warranties that are controlled by the manufacturer, not ATC by Fiallo. Manufacturer warranties may vary by product, component, glass, frame, hardware, finish, labor coverage, registration, transferability, exclusions, and claim procedure.

Any ATC by Fiallo workmanship warranty, if offered, must be stated in writing. Warranty coverage does not apply to damage caused by misuse, lack of maintenance, accidents, storms, flooding, structural movement, settlement, water intrusion from unrelated areas, unauthorized modifications, third-party work, normal wear, corrosion beyond warranty terms, improper cleaning, customer damage, or conditions outside the written warranty.

Warranty claims may require inspection, photos, proof of purchase, manufacturer review, maintenance records, and reasonable access to the property.

32. Maintenance

Customers are responsible for maintaining installed products according to manufacturer recommendations and normal Florida coastal climate considerations. Maintenance may include cleaning tracks, lubricating moving parts where appropriate, inspecting seals, removing debris, operating shutters periodically, checking locks, avoiding harsh chemicals, and reporting issues promptly.

Failure to maintain products may affect operation, appearance, water performance, warranty coverage, and storm readiness.

33. Construction Liens and Nonpayment

Florida law may allow contractors, subcontractors, laborers, and material suppliers who provide labor, services, or materials to improve real property to assert lien rights if they are not paid. Customers should understand that construction lien rights and notice requirements are governed by Florida law and may apply to certain projects.

ATC by Fiallo may use lawful remedies to collect unpaid amounts, including suspension of work, collections, lien rights where available, legal action, recovery of fees or costs if allowed by contract and law, and withholding non-required deliverables until payment is resolved.

Customers may request appropriate payment documentation, lien releases, or closeout information where applicable and consistent with the written agreement and Florida law.

34. Photos, Project Documentation, and Marketing

ATC by Fiallo may take photos or videos of work areas, existing conditions, measurements, product labels, progress, completed installations, damages, warranty issues, and project documentation for internal records, quality control, permitting, warranty, dispute resolution, insurance, and business purposes.

Unless the customer objects in writing, ATC by Fiallo may use non-sensitive project photos or videos for portfolio, educational, marketing, social media, website, or advertising purposes. We will make reasonable efforts not to publicly display private personal information, security-sensitive details, or personal identifying information without permission.

35. Dispute Resolution and Opportunity to Cure

If a customer has a concern about workmanship, service, product condition, scheduling, billing, warranty, or project completion, the customer agrees to promptly notify ATC by Fiallo in writing and provide a reasonable opportunity to inspect, respond, and correct any issue where correction is appropriate.

Customers should not hire third parties to alter, remove, repair, or replace ATC by Fiallo’s work before providing notice and a reasonable opportunity to inspect, unless emergency action is necessary to prevent immediate damage or safety risk.

36. Limitation of Liability

To the fullest extent permitted by law, ATC by Fiallo is not liable for indirect, incidental, special, punitive, consequential, or economic damages, including lost profits, lost rent, loss of use, business interruption, inconvenience, emotional distress, loss of opportunity, insurance premium changes, or third-party claims arising from use of the website, project delays, product availability, or services, except where prohibited by law.

ATC by Fiallo’s responsibility for any project is limited by the written agreement, applicable law, actual amounts paid for the specific service giving rise to the claim, manufacturer warranty terms, and exclusions stated in this document or project documents.

37. Right to Suspend or Decline Work

ATC by Fiallo may decline, pause, suspend, or terminate work if:

● Required payments are not made.
● Required approvals, permits, access, or customer decisions are not provided.
● Unsafe conditions exist.
● Hidden conditions materially change the project.
● The customer requests unpermitted, unsafe, illegal, or non-compliant work.
● The customer, occupant, tenant, representative, or third party interferes with work or creates a hostile or unsafe environment.
● Materials are unavailable or the scope becomes commercially or technically impractical.

38. Governing Law

This document and use of the website are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any project-specific agreement may include its own governing law, venue, dispute resolution, arbitration, mediation, or attorney fee terms.
